Waiver and Release of Liability Express assumption of risk: I, the undersigned, agree to the following on behalf of myself and or my child(ren) who wish to participate in the activities offered at Masters Academy Bristol LLP. I am aware that there are significant risks involved in all aspects of physical training. These risks include, but are not limited to: falls, throws, striking, grappling and additional competitive contact activities which could potentially result in serious injury or death due to negligence on the part of myself(, my child), training partners, or other people in the area. I am aware that any of these above mentioned risks may result in serious injury or death to myself and or my partner(s). I also am aware that these same risks apply to all students and age groups within all programs offered by Masters Academy Bristol LLP. I understand participation in a contact sport carries inherent risk and willingly assume full responsibility for the risks that I am exposing myself or my child to and accept full responsibility for any injury that may result from participation in any activity or class while at, or under direction of Masters Academy Bristol LLP I acknowledge that I and or my child have no physical impairments, injuries, or illnesses that will endanger myself, themselves, or others. Release: In consideration of the above mentioned risks and hazards and in consideration of the fact that I am willingly and voluntarily participating in the activities offered by Masters Academy Bristol LLP I, the undersigned hereby release Masters Academy Bristol LLP, their principals, agents, employees, and volunteers from any and all liability, claims, demands, actions or rights of action, which are related to, arise out of, or are in any way connected with my participation, or my child’s participation in this activity, including those allegedly attributed to the negligent acts or omissions of the above mentioned parties. This agreement shall be binding upon me, my successors, representatives, heirs, executors, assigns, or transferees. If any portion of this agreement is held invalid, I agree that the remainder of the agreement shall remain in full legal force and effect. If I am signing on behalf of a minor child, I also give full permission for any person connected with Masters Academy Bristol LLP to administer first aid deemed necessary, and in case of serious illness or injury, I give permission to call for medical and or surgical care for the child and to transport the child to a medical facility deemed necessary for the well being of the child. Indemnification: The participant recognizes that there is risk involved in the types of activities offered by Masters Academy Bristol LLP. Therefore the participant accepts financial responsibility for any injury that the participant may cause either to him/herself or to any other participant due to his/her negligence. Should the above mentioned parties, or anyone acting on their behalf, be required to incur attorney’s fees and costs to enforce this agreement, I agree to reimburse them for such fees and costs. I further agree to indemnify and hold harmless Masters Academy Bristol LLP, their principals, agents, employees, and volunteers from liability for the injury or death of any person(s) and damage to property that may result from my negligent or intentional act or omission while participating in activities offered by Masters Academy Bristol LLP, at the main building or abroad. This includes but is not limited to parks, recreational areas, playgrounds, areas adjacent to main building, and/or any area selected for training by Masters Academy Bristol LLP. I have read and understood the foregoing assumption of risk, and release of liability and I understand that by signing it obligates me to indemnify the parties named for any liability for injury or death of any person and damage to property caused by my negligent or intentional act or omission. I understand that by signing this form I am waiving valuable legal rights. Photography/Video Release Participants involved in any activities offered by Masters Academy Bristol LLP may be photographed or videotaped during training. The undersigned hereby consents to the use of these photographs and/or videos without compensation, on the Masters Academy Bristol LLP website or in any editorial, promotional or advertising material produced and/or published by them.     Terms and conditions
  1. Acceptance as a Member
The supplier, Masters Academy Bristol LLP, shall have absolute discretion upon whether to accept the application for membership of an applicant as a Member of the Club. Upon acceptance, the Member shall be entitled to all the rights and privileges exercisable by the class of membership for which his/her application to the Club is granted. ACCEPTANCE BY MASTERS ACADEMY BRISTOL LLP OF AN APPLICATION FOR MEMBERSHIP OF THE CLUB SHALL CONSTITUTE A BINDING CONTRACT BETWEEN THE MASTERS ACADEMY BRISTOL LLP AND THE MEMBER UPON THE TERMS AND CONDITIONS OF MEMBERSHIP.
  1. Physical condition of the Member.
The Member warrants and represents that he/she is in good physical condition and the information contained in his/her Physical Activity Readiness Questionnaire and Student Application is true and accurate. Furthermore, he/she warrants that he/she is capable of engaging in active or passive exercise and that such exercise would not be detrimental to his/her health, safety, comfort or physical condition. Membership of the Club is personal and cannot be assigned, transferred or otherwise disposed of save with the prior written agreement of Masters Academy Bristol LLP such consent not to be unreasonably refused, but subject to sat­isfactory completion of a process of fitness assessment, and payment of a reasonable administration charge. All memberships cover is 47 weeks training per year divided over 12 months. No refunds are given for breaks or public holidays, unused sessions or partial months missed training. Some classes/events may be excluded from this membership. Joint Members shall be subject to the rules governing individual Members and each Member shall be jointly and severally liable for the full contract value and any costs incurred as a result of obtaining payment.
  1. Joining fee and Membership Subscriptions.
From the date of being accepted as a Member, membership shall continue for a minimum period of 2 months unless terminated in accordance with this agreement and shall continue thereafter until terminated in accordance with this agreement. Beginning when the Member is accepted for membership all Members shall pay either a monthly subscription by direct debit or at Masters Academy Bristol LLP’s discretion an agreed amount in advance. These amounts shall be payable by each Member irrespective of the actual usage of the Club or change in personal circumstances (including any assignment permitted under paragraph 3 above). All Members shall pay a joining fee, which shall become due and payable immediately upon becoming accepted as a Member. Membership must remain current in order to avoid paying the joining fee again. All prices displayed on https://dev.mastersacademybristol.co.uk are valid for a maximum of 14 days unless otherwise stated.
  1. Termination & Cancellation of Membership
Masters Academy Bristol LLP may terminate the membership of any Member; (i) Without notice and with immediate effect in the event that a Member either: (a) Commits a serious breach of the Club Rules displayed within the Club or the Members Conduct Rules set out at paragraph 7 below (which may include, by way of example, violence, excessive use of bad language, threatening behaviour or inappropriate sexual activities, in a way which disturbs the enjoyment of the Club by other Members) or, (b) Repeatedly breaches the Members Conduct Rules or, (c) In the event of a breach, capable of remedy, does not remedy the same within seven days of receipt of a written default notice from Masters Academy Bristol LLP or, (d) Acts in a manner that is, in the reasonable opinion of Masters Academy Bristol LLP, unacceptable. (ii) If any part of the monthly membership subscription remains unpaid after the date due for payment, following written demand by Masters Academy Bristol LLP addressed to the Member at the most recent address notified by that Member to the Club, giving not less than seven days’ notice to rectify such non-payment. In the event of termination of the membership of any Member in accordance with paragraph 6 (a) above the Member will be liable to pay reasonable compensation to the Club in respect of any monies which at the time of such termination are owing to the Club in accordance with the contractual agreement, alternatively, if money has been paid in advance under this agreement, to retain a proportion of the money so paid, to cover any reasonable costs or losses incurred. The Member may cancel the membership by giving 30 days written notice to terminate the membership, and such notice may be given at any time after the minimum membership period. In those cases where membership has been paid in advance, and where the minimum membership period (if applicable) has expired, upon termination by the Member in accordance with paragraph (d) above the Member will be entitled to a refund, calculated proportionately to the full membership fees payable for such period, taking account of the monthly subscription rate currently charged, and subject to a reasonable administration charge. In cases where a membership has been purchased without any prior contact with Masters Academy Bristol LLP, the Member has a 14 day “cooling off” period, in which they can cancel their membership by giving written notice to terminate the membership. In which case, the membership subscription will be refunded within 30 days. The Member is responsible for cancelling their own membership payments and demonstrating reasonable diligence in the matter of cancellation. Masters Academy Bristol LLP will not refund uncancelled payments, partial months or unused lessons. In the event of termination/cancellation of the membership within the first 30 days of the agreement, the Member is to return any goods related to their membership that were received by them from Masters Academy Bristol LLP. This is to be done within 30 days of the termination of their membership and the Member is to cover all postage, shipping, and handlings costs associated with the return of the goods. If the Member is unable to return the goods, a reasonable fee is to be paid by the Member to Masters Academy Bristol LLP to cover the cost of replacing the goods.
  1. Members Conduct
  • Comply with any applicable Dress Code for the Club;
  • Show consideration for other Members and their Guests and staff in and around the Club’s premises;
  • Not use abusive or bad language;
  • not bring, use or be under the influence of illegal drugs in any part of the Club’s premises;
  • Not be drunk in or about the Club’s premises;
  • Not behave in an anti-social or disruptive manner, including but not limited to inappropriate or threatening behaviour, misuse of equipment or sexual activities.
  1. Alterations or Variations
This Membership Agreement of the Club Rules may be revoked, supplemented or altered by Masters Academy Bristol LLP at its discretion and Masters Academy Bristol LLP shall give the Members reasonable notice in advance of such changes via Email if the changes affect any fee or charges the Member is liable to pay. Where the change to the Terms and Conditions is otherwise material (such as where there is a significant change in the level or type of facilities offered by the Club, or the location of the Club is changed), the Member can cancel his or her membership by giving one complete calendar month’s written notice to terminate the membership within 30 days of receiving notice from Masters Academy Bristol LLP. Members who do not wish to accept an increase in subscription may cancel their membership by giving written notice. The written notice period shall in all cases be not less than one calendar month. If such notice would otherwise expire before the initial period of membership, it shall be deemed to expire on the last day of such initial period of membership. The Member giving notice must continue to pay subscriptions at the rate current immediately prior to any proposed increase until the end of such notice period.

  1. Law and Jurisdiction
Contracts for the purchase of items and services through our site will be governed by English law.  Any dispute arising from, or related to, such Contracts shall be subject to the non-exclusive jurisdiction of the courts of England and Wales.
